I was Caught Smoking Pot. Should I Hire a Drug Crimes Lawyer?

Smoking Pot LawyerIf you’ve been caught smoking marijuana, you should have skilled, qualified assistance from a drug crimes attorney. Depending on the circumstances of your arrest, you are most likely facing some very serious, life-altering consequences as a result of being caught smoking pot. Though marijuana is the most commonly used illegal drug in the USA, it is still illegal. And though pot possession in small amounts and on a first-time charge in Ohio has been decriminalized, don’t be fooled. This is serious.

It is somewhat deceptive in Ohio law that a first-time conviction for pot possession carries no potential for jail time, only a $150 maximum fine, and is classified as not much more than a traffic violation. But a minor criminal record is still a criminal record. And if you’re convicted of even a misdemeanor, you will have a criminal record.

There are separate penalties for possession, sales, distribution or trafficking, and possession or sale of paraphernalia. Here’s something else to consider when facing these charges – drug conviction on any count may earn a driver’s license suspension for anywhere between 6 months and 5 years.  If drug crimes are committed within 1000 feet of a school, or by repeat offenders, penalties increase.

Ohio Revised Code also forbids forcing someone to ingest drugs, furnishing drugs to a minor, or causing a minor to commit a felony drug offense. These are all illegal in Ohio and are called “corrupting another with drugs.” These crimes are punishable with a fine of $2,500 or more, and between six and 18 months in jail. (Ohio Rev. Code Ann. § 2925.02.)

First time offenders will find some leniency in Ohio’s penalties and sentencing.  Because the state has decriminalized possession of small amounts for personal use, the penalty amounts to a minor traffic violation. However, if the charge is in connection with a moving violation (operating a vehicle impaired or OVI) penalties are very serious and expensive, both in time, money, and in damage to your present and future.
